Hill Bombing Skateboarder Suffers Fatal Accident In Glendora

Hill Bombing Skateboarder Suffers Fatal Accident In Glendora

A 20-year-old UC Irvine student died on March 20, 2015 in the Angeles National Forest while skateboarding down Glendora Mountain Road, just north of Glendora.
Eric Pederson, was "hill bombing" down the road, veered onto oncoming traffic, and fatally collided with a dump truck.
He was riding a long-board style skateboard and traveling approximately 20 mph before the deadly accident.
This occurred at about 10:00 am.
Hill bombing is the act of skateboarding downhill on a longboard as fast as you can.
Pederson had one friend riding in front of him and another friend riding behind of him. Another friend was following them in a van. On a right curve on the road, he failed to turn, and crossed over into oncoming traffic where he fatally collided with a 2000 Freightliner dump truck.
He was wearing safety gear during the collision, including a helmet and knee pads.
Skateboarding is prohibited on forest road, but thrill-seeking skateboarders still manage to find a way to engage in the activity, especially during the summer.
On YouTube, many users post videos of racing downhill on Glendora Mountain Road.

The One Reason Why You Might Need More Car Insurance Coverage

The One Reason Why You Might Need More Car Insurance Coverage

West Covina Accident and Injury Lawyer, Lem Garcia, Explains Why You Might Need More Car Insurance Coverage

Your car insurance may only cover the damage to your vehicle if you are involved in an accident with an uninsured motorist. - West Covina Accident and Injury Lawyer, Lem Garcia
YOUR CAR INSURANCE MAY ONLY COVER THE DAMAGE TO YOUR VEHICLE IF YOU ARE INVOLVED IN AN ACCIDENT WITH AN UNINSURED MOTORIST. - WEST COVINA ACCIDENT AND INJURY LAWYER, LEM GARCIA
Even though there are serious penalties for driving without car insurance in California (license suspension, citation, car impoundment, and large fines), California still has the highest number of uninsured motorists according to the Insurance Research Council.
Approximately 4.1 million drivers in California are driving without any car insurance coverage. Why is this bad? This is bad because if one of these uninsured motorists hit you, you won't be able to recover anything for your bodily injury or property damage from an insurance company. Worse yet, because uninsured drivers typically don't have any assets to compensate you for the damages you suffered, you won't be able to recover anything for your damages from the at-fault driver either.

What Can You Do If An Uninsured Driver Hits You?

You hope and pray that your car insurance policy includes uninsured motorist coverage. People often believe that because they have "full coverage" that their car insurance company will take care of them no matter what when they're involved in a car accident. This is not true. In fact, full coverage does not truly exist.

Types of Car Insurance Coverage

Generally, when people refer to full coverage, they are referring to a policy that provides the following:
  1. Liability Coverage: pays for the bodily injury and property damage that you cause in an accident.
  2. Collision Coverage: pays for the property damage to your vehicle in a car accident.
  3. Comprehensive Coverage: pays for the property damage to your vehicle that was not caused by a car accident (e.g. theft, vandalism, fallen tree).
While this may sound like plenty of coverage, there are still many situations where it will prove to be grossly inadequate:
  1. Medical Payments: payment for medical treatment necessitated by a car accident.
  2. Rental Reimbursement: payment for a car rental while your car is being repaired after a car accident.
  3. Uninsured Motorist: payment for property damage, bodily injury, medical treatment, and pain and suffering in the event you are involved in an accident with an uninsured driver.
  4. Underinsured Motorist Protection: payment for property damage, bodily injury, medical treatment, and pain and suffering in the event you are involved in an accident with an insured driver whose policy limits are insufficient to compensate you for your damages.
  5. Gap Insurance: payment for the difference between how much you owe on your car and the value of your car if your car has been totaled in a car accident.
  6. Emergency Roadside Service: payment for the towing and labor on your car if your car needs to be towed.

Why You Might Need More Car Insurance Coverage

As you can see, even if you have "full coverage" your insurance coverage may come up short if you are involved in a car accident. For example, if you have full coverage and are hit by an uninsured motorist, your collision coverage will pay for the repairs to your car (after you have paid your deductible), but you have no available coverage for your medical bills and pain and suffering. However, if you had uninsured motorist coverage and were hit by an uninsured motorist, your uninsured motorist insurance will pay for your medical bills and compensate you for your pain and suffering up to your policy limits.
If you don't have uninsured motorist coverage and you are hit by an uninsured driver, you may have coverage for your some property damage and some medical bills, but you probably won't be able to recover anything for your pain and suffering.

Check Your Car Insurance Policy Today

Take the time to know the extent of your car insurance coverage so you won't be left footing the bill for a car accident that wasn't your fault. Uninsured motorist coverage is often a small additional fee and could be very well worth it in the end.

Can I Recover For My Bus Accident Injuries? - By Accident and Injury Lawyer Lem Garcia

Bus passengers are owed a high degree of care and may be entitled to compensation if they are injured while riding the bus.
BUS PASSENGERS ARE OWED A HIGH DEGREE OF CARE AND MAY BE ENTITLED TO COMPENSATION IF THEY ARE INJURED WHILE RIDING THE BUS.
When you ride the public bus, you trust that the bus company hired responsible and competent drivers who will drive carefully when they take you from one place to another. Unfortunately, bus drivers may drive negligently, or even worse, recklessly, and cause serious injuries to you and your fellow passengers.
Some people believe that when they ride the public bus they are taking the risk that the driver will drive negligently and they will not be able to recover anything if they are injured while they are riding the bus. This is not true. If you have been injured by the negligence or recklessness of a bus driver, you may be able to receive compensation for your medical care, missed time from work, and pain and suffering.

Bus Drivers Are Held To A High Degree of Care

Common carriers are held to a high standard of care in the safety of its passengers. Common carriers are simply businesses that transport people from one place to another for money. Public buses take people from one place to another for a fee and is therefore considered a common carrier. As a common carrier, the public bus according to the California Civil Jury Instructions "must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property]. "

Act Quickly To Preserve Your Rights

Therefore, if you or someone you know has been injured by the negligence or recklessness of a bus driver, it is important that you speak to an attorney to not only know your legal rights, but also to preserve them. You only have a limited amount of time to pursue your claim. If you do not act on your claim within the time allowed, you may lose all of your rights to seek compensation. Generally, the statute of limitations for personal injury claims in California is two years form the date of injury, but some common carriers impose a shorter statute of limitations to pursue your claim.

If You Think You Might Need a Personal Injury Attorney, You Probably Do

Not only will an attorney to help you preserve your rights, but an attorney will also help you build your case from the beginning so that valuable evidence is not lost and important witnesses are interviewed promptly before their memory fades. If you wait to speak to an attorney, critical evidence may be lost and the value of your claim could be significantly diminished or lost entirely. Whether you decide to speak to a lawyer or not, it is important that you know what are the common types of bus accidents you may be able to receive compensation for.

Common Types of Bus Accidents

Bus drivers typically breach their duties by operating the vehicle negligently. This includes but is not limited to the following:
  1. Driver accelerated too quickly;
  2. Driver applied to brakes too abruptly;
  3. Driver failed to operate the handicap equipment competently;
  4. Driver disobeyed traffic laws, signs, and signals;
  5. Driver was speeding;
  6. Driver inexperience;
  7. Driver was at fault in a car accident;
  8. Driver was texting while driving;
  9. Driver was on the phone while driving;
  10. Driver was trained poorly
  11. Driver was under the influence of drugs or alcohol;
  12. Distracted driver;
  13. The bus was maintained poorly.

How to Prevail on Your Bus Accident Claim

In order to prevail, you must prove the following:
  1. The Defendant owed the Plaintiff a duty  (common carriers owe its passengers a high degree of care);
  2. The Defendant breached that duty;
  3. The breach was the proximate and legal cause of the Plaintiff's injury;
  4. The Plaintiff suffered an actual injury.

West Covina Personal Injury Lawyer, Lem Garcia

I believe that if you or someone you know has been injured while riding the public bus, it is important that you speak with a lawyer right away to make sure you preserve the value of your case, build a strong case from start to finish, and ultimately maximize your compensation for your injuries.

Why I Enjoy Being A Personal Injury Attorney

I enjoy being a personal injury attorney because I love helping other people.

When I was a child, my goal wasn't always to become an attorney. All I wanted to do was help other people. I discovered that I wanted to become a personal injury attorney when I came across a lot of people who had been taken advantage of by the insurance company. I had injured friends and family that were offered a little bit of of money for their serious injuries and they didn't always know where to turn.

I thought that if I helped them, they would have someone who genuinely cared about them and could work hard to get them the best possible result for their case. They often told me that they had attorneys who were helping them, but they didn't always answer their calls and they treated them like a file. I saw an opportunity to help other people and I took it.

I enjoy giving people the personal attention and hard work their case needs to help them get the most for their injuries. I take great pride and joy in seeing my clients feel like their rights have been vindicated after they receive their settlement award.

I am a personal injury attorney in West Covina, but I also help others in the surrounding area.
